1.1. These terms apply to all quotations, agreements, contracts, and services provided by Oudriss Drive Services (ODS), unless explicitly agreed otherwise in writing. Deviations from these terms are valid only if confirmed in writing by both parties. The customer’s general terms and conditions are explicitly excluded unless ODS has accepted them in writing, and only to the extent they do not conflict with these terms.
1.2. Privacy: ODS uses customer data solely to deliver its services and keep customers informed of relevant updates. This includes vehicle details, contact information, and the pickup address for the chauffeur. By accepting these terms, the customer agrees to this privacy policy.
1.3. Chauffeur Selection: ODS reserves the right to assign chauffeurs at its discretion. Customers cannot reject an assigned chauffeur. ODS is not liable for fines, parking fees, tolls, fuel costs, maintenance, insurance, or any other vehicle-related expenses, which remain the sole responsibility of the customer. Travel expenses for the chauffeur to and from the location will be charged separately.
1.4. ODS is committed to providing high-quality service with professional chauffeurs who handle the customer’s vehicle with care. However, ODS has a best-effort obligation rather than a results-based obligation.
2.1. Quotations are based on information provided by the customer and are binding. Any deviations from a confirmed booking are valid only after written approval by ODS. If a booking is canceled by the customer, the full fee remains payable.
2.2. The agreement takes effect upon digital confirmation by ODS. Service begins as soon as the chauffeur departs for the agreed address. Chauffeurs are entitled to a 15-minute break after every three hours of continuous driving.
2.3. The customer confirms ownership of the vehicle driven by the chauffeur or provides prior written consent from the owner. The customer ensures the vehicle is in good technical condition and meets all legal requirements, including insurance.
3.1. All ODS prices are exclusive of VAT. A minimum booking of three hours per trip applies. Both driving and waiting time are charged.
3.2. Trips can be booked up to one hour in advance. ODS is not responsible for unavailability of chauffeurs.
3.3. Cancellation:
4.1. Invoices are based on hours logged via the ODS app. These records are binding. Invoices must be paid within 10 days of the invoice date.
4.2. Late payments will automatically incur interest as per legal provisions, along with a fixed compensation of 15% of the outstanding amount.
5.1. ODS may terminate the agreement without prior notice if the customer fails to meet contractual obligations or is declared bankrupt. In such cases, all outstanding amounts become immediately due.

7.1. ODS is not liable for damage to the vehicle or customer property unless caused by gross negligence or intentional misconduct by the chauffeur.
7.2. The customer indemnifies ODS against any claims from third parties, including insurers, arising from the use of the vehicle by an ODS chauffeur.
